1. Scope of Service

Algo Hosting provides unmanaged virtual infrastructure tailored for algorithmic trading, software development, and financial compute use cases. All services are delivered as-is, with no guarantees regarding uptime, performance, profitability, or continuity.

2. Eligibility

Clients must be 18 years or older and act in a business or professional capacity. We do not provide services intended for consumer, household, or recreational use.

3. Acceptable Use

You agree not to:

  • Send spam or unsolicited messages
  • Launch or assist DDoS attacks, port scans, or brute-force attempts
  • Host crypto miners, arbitrage bots, or strategies that flood infrastructure
  • Use servers as VPNs, proxy relays, or for anonymization services
  • Store or distribute pirated, illegal, or obscene content
  • Operate IRC bots, ransomware, backdoors, or malware infrastructure
  • Deploy trading bots that overload CPU, bandwidth, or external APIs

Algo Hosting defines abuse at its sole discretion and may immediately suspend or terminate your service without refund.

4. Performance & Availability

Unless specified in a Service Level Agreement (SLA), no uptime is guaranteed. Clients are solely responsible for:

  • Creating their own offsite backups
  • Operating system or application configuration
  • Securing access credentials and patching software

Algo Hosting is not liable for:

  • Missed trades or financial loss
  • Infrastructure downtime
  • Corruption or deletion of data

5. Payments & Billing

  • Services are prepaid and non-refundable once provisioned
  • If payment is not received within 48 hours after the due date, the service will be suspended
  • Data and VPS will be permanently deleted after 72 hours of non-payment
  • We do not offer prorated refunds or service credits

6. Chargebacks & Fraud

Initiating a chargeback or payment dispute without prior contact will result in:

  • Immediate account termination
  • Blacklisting from future use
  • Optional legal or collection action

Contact support before raising disputes with your payment provider.

7. Software Licensing

You are solely responsible for ensuring legal licensing for all software, including operating systems. Algo Hosting may facilitate activation (e.g. via KMS) but does not assume liability for compliance.

8. Termination

Algo Hosting may suspend or terminate your services, without notice, for:

  • Violation of these Terms or the Acceptable Use Policy
  • Infrastructure abuse or resource overload
  • Any activity deemed illegal or high-risk

Repeat offenders will be permanently excluded from future use. No refunds will be issued for terminated services.

9. Indemnity & Liability

You agree to indemnify Algo Hosting, its owner, and its infrastructure providers from any claims, damages, or legal fees related to your use of the service.

Our maximum liability is limited to the amount paid in the 30 days prior to a dispute.

10. Force Majeure

Algo Hosting is not liable for downtime or failures resulting from events beyond our control, including upstream outages, cyberattacks, hardware failures, or legal enforcement actions.

11. Jurisdiction

This Agreement shall be governed by Dutch law. All disputes shall be submitted to the court of Amsterdam, the Netherlands.

12. Amendments

We may modify these Terms at any time. Continued use implies acceptance of the latest version.
